These are the terms and conditions on which we will arrange bookings for our services, such as Groups, Guided Tours, Self-drive Tours, accommodation, transfers, excursions, or other vacation requirements. Please read them carefully as they set out our respective rights and obligations. References to “you” and “your” in these terms mean all persons on the booking (including anyone added or substituted at a later date). “We”, “us”, “our” and “Nordical” refers to Nordical Iceland.
Fare
The total price of the booking, including taxes and other fees. The Fare covers the services specified in the booking in question.
Tour
Defines a travel product we offer that consists of multiple components, such as transport arrangements, car hires, accommodation, or any other tourist service(s). Where you book a single separate individual component from us (e.g., accommodation only or excursion only), you have booked a ‘Single Component’.
Guided Tours / Activities & Tickets
A Guided Tour is a Tour where you travel in a group under the guidance of a guide. Activities & Tickets consist of Activites, transfer and attraction tickets. The included services can be found in the respective Tour.
Self-Drive Tours
A Self-drive tour is a Tour where you travel by yourself in a rental car. The included services can be found in the respective Tour.
Customer
The individual or individuals who have booked a Tour with Nordical Iceland ehf. and every individual member of a Group Booking.
FIT/Individual Booking
A booking made by individual Customers up to 9 persons.
Group Booking
A booking for a group of Customers consisting of at least 9 persons or more.
Promotional Material
Advertisements, sale brochures, offers, targeted emails, and other material from Nordical where Tours are advertised and promoted.
Confirmation Fee
The part of the Fare that shall be paid upon booking. The FIT/Individual Booking Confirmation Fee is 15% of the total Fare of the Tour, The Group Booking Confirmation Fee is 20% of the total Fare of the Tour, and is non-refundable.
Cancellation Protection
Our Cancellation Protection is a product that can be purchased. It enables Customers to cancel a Tour within 72 hours before arrival and receive a full refund, minus the fee of the Cancellation Protection (FIT/Individual Booking only).
Group Contact
The individual who represents the entire group with regards to Group Bookings.
Service Provider
Parties that provide the individual services included in the Tour. E.g., transport operators, hotels, and activity providers.
Special Requests
Customers’ requests for special conditions, items, and other services that are not specifically included in the Tour itinerary.
2.1 These Terms and Conditions apply to all bookings made with Nordical, unless otherwise stated in Promotional Material or special terms or agreements with Customers.
3.1 A booking is considered to have been made when a Customer has placed a booking with Nordical and paid the Confirmation Fee. A booking is not considered to have been made unless the Confirmation Fee has been paid.
3.2 Nordical cannot guarantee the availability of Tours promoted by the company at the time of booking. Bookings provided by Service Providers are subject to availability and change.
3.3 Included in the Fare is the service specified in the relevant booking. Special Requests that require additional costs shall be paid for separately according to Nordical’s price list and the relevant Service Provider’s price list.
3.4 Upon booking, the Customer has confirmed that they have read and accepted Nordical’s Terms and Conditions and Privacy Policy. All bookings are subject to terms in the Promotional Material, these Terms and Conditions, and that of the relevant Service Providers and any terms set out in the booking.
3.5 If a Customer makes any Special Requests, the request shall be specified in the booking. These Special Requests do not form part of the Tour unless specifically agreed. Nordical cannot guarantee that in all cases it will be possible to comply with Customer’s Special Requests.
3.6 All bookings must be made by a person older than 18 years.
4.1 Payment of the Confirmation Fee is required for the booking to be confirmed and entered into the Nordical system. The Confirmation Fee is non-refundable. The Confirmation Fee shall be 15% of the Fare for The FIT/Individual Booking, and 20% of the Fare for The Group Booking. Nordical reserves the right to require a higher Confirmation Fee for certain Tours.
4.2 The remaining Fare shall be paid on a due date no later than 30 days before departure in the case of Individual Bookings.
4.3 For Group Bookings of 9 passengers or more or special Tours:
a) 20% Confirmation fee shall be paid at the time of booking.
b) Additional 30% of the Fare shall be paid 90 days before the departure date or more (50% of total amount).
c) The remaining Fare shall be paid 30 days before the departure date or more.
Note. These payment terms apply unless otherwise stated in the Promotional Material or the booking.
4.4 In the event of late payment, Nordical reserves the right to claim penalty interest and payment of all Nordical costs resulting from the late payment. If the delay in payment is significant, Nordical reserves the right to terminate the contract with the Customer without liability to the Customer. In the event of cancellation due to late payment of the Customer, the Confirmation Fee remains non-refundable.
5.1 Schedules in the itinerary given when booking a Tour are estimated and may change from the date of booking until departure if required. Itineraries might change due to unfavorable weather conditions or unforeseen circumstances.
5.2 We reserve the right to make changes to bookings at any time. If we make an insignificant change, we will make reasonable efforts to inform you as soon as reasonably possible, but we will have no liability to you. Such notifications shall state the type of change in question, and whether it affects the price of the Tour. Insignificant changes are e.g., a change of Service Providers. In such cases, Nordical will endeavor to offer services of comparable quality.
5.3 Activities and excursions provided by Service Providers are dependent on the weather conditions. If a service needs to be canceled by the Service Provider, we will try to offer you an alternative option, or issue a refund/partial refund.
5.4 Nordical may cancel a Tour against a refund of the Fare, without payment of damages, in the following cases:
a) Tours of more than 6 days: up to 20 days prior to departure
b) Tours of 2 – 6 days: up to 7 days prior to departure
c) Tours of less than 2 days: up to 48 hours prior to departure
5.5 When canceling a Tour according to Article 5.4. the Customer is entitled to a refund of the Fare within 14 days of cancellation.
5.6 In the event of a cancellation of a Tour by Nordical, Nordical may but is not obliged to offer a similar Tour that is comparable in quality. If the alternative Tour is more expensive, the Customer shall pay the Fare difference and the payment must be made no later than 7 days before the start of the Tour. If the Tour is cheaper, the Customer will receive a refund within 14 days of changing the booking.
6.1 If a Tour is canceled by you, cancellation is only permitted against payment of a cancellation fee in accordance with Articles 6.2 and 6.3 due to Nordical’s costs, inconvenience, and loss of income due to the cancellation. The Confirmation Fee is in no case refundable upon cancellation of the Tour in such cases.
6.2 When canceling an Individual Booking, which is not part of a Group Booking, the following cancellation fee will be charged, unless otherwise stated in the Promotional Material or in special terms with the Customer:
a) If a Tour is canceled 14 days before the departure date or more, 85% of the Fare is refundable but not the Confirmation Fee.
b) If a Tour is canceled less than 14 days before the departure date, the Customer will not receive a refund.
6.3 When canceling a Group Booking, the following cancellation fee will be charged, unless otherwise stated in the Promotional Material or in special terms with the Customer. In addition, Nordical may charge a fee for Nordical’s expenses incurred by Nordical’s Service Providers, such as for deposits for flights, accommodation, and other services in addition to Nordical’s loss of revenue.
a) If a Tour is canceled 90 days before the departure date or more, 20% cancellation charge.
b) If a Tour is canceled within 60-89 days before the departure date, 30% cancellation charge.
c) If a Tour is canceled within 30-59 days before the departure date, 50% cancellation charge.
d) If a Tour is canceled within 20-29 days before the departure date, 70% cancellation charge.
e) If a Tour is canceled within 0-19 days before the departure date, 100% cancellation charge.
6.4 If the cancellation terms of the Nordical Service Provider go beyond these terms, the rule that goes further applies.
6.5 In the event that you wish to cancel a Single Component you will have to pay the cancellation charges imposed by the Service Provider and detailed in their terms and conditions.
6.6 The Customer must cancel the Tour in a verifiable manner. If Customers exercise their right of cancellation in accordance with these Terms and Conditions, a refund shall be made within 14 days of the cancellation.
6.7 Nordical Customers (FIT/Individual Booking only) can purchase a Cancellation Protection for their Tour. If the Tour is canceled within 72 hours before arrival, it will be fully refunded including the Confirmation Fee but excluding the cost of the Cancellation Protection. Please note that this product may not be available if the Customer has requested special services, such as a specific hotel.
7.1 The Customer or Group Contact is responsible for ensuring that the Customer information is correct, such as the name, date of birth, and other information necessary to complete the booking. Nordical is not responsible if incorrect information is provided, or spelling errors are in the name of the passenger or its consequences. In the event of name changes or corrections, Service Providers may charge change fees to be paid by the Customer.
7.2 It is the responsibility of the Customer to arrive for departures, excursions, and other events at the time specified in the booking or other travel documents. If the Service Providers are unable to reschedule, these services will not be refunded, and additional costs may be incurred in the event of having to rearrange.
7.3 The Customer is responsible for having valid travel documents with them, e.g., passports and visas, or other documents or certificates, especially medical certificates such as COVID-19 vaccination or antibody certificates and any other specific medical forms and certificates required by Service Providers for their activities. If a Customer is traveling with children, they are responsible for carrying travel documents and other relevant documents.
7.4 The Customer is responsible for ensuring that they are physically and mentally healthy for the Tour for which they are making an agreement. Should a Customer need special assistance due to illness or disability, e.g., is in a wheelchair, vision or hearing impaired, etc., then the Customer must notify Nordical before booking. Customers in need of special assistance are advised to familiarize themselves with the terms of airlines and other Service Providers and the services they provide. If a Customer is pregnant, the person in question is also advised to familiarize themselves with the Service Providers terms. If a Customer falls ill on a journey, he or she is responsible for the costs that may be incurred, as well as the costs of the return journey. A Customer is not entitled to a refund even if they do not complete the journey for these reasons or others for which Nordical will not be blamed, but Nordical seeks the assistance of Customers in such cases.
7.5 Nordical advises all Customers to insure themselves with travel insurance for unforeseen instances, such as theft, damage or loss of valuables, repatriation, etc.
7.6 Customers are obliged to obey the instructions of the tour guide or the staff of Nordical Service Providers. Customers must comply with the laws and regulations of public bodies in the countries to which they travel to, take into account their customs, and comply with the rules and conditions of Service Providers. If a Customer breaks off in this respect, or at the beginning of a Tour gives reason to believe that they are bothering their fellow travelers with their behavior, Nordical may prevent them from starting their journey or continuing it, and they must then end it at their own expense, without recourse against Nordical.
7.7 A Customer is not entitled to a refund of the Fare or cost or to the payment of damages if they do not meet the conditions of this article.
8.1 Nordical is not responsible for the services that Customers buy themselves for their Tour without the intervention of Nordical.
8.2 Nordical reserves the right to correct errors or inaccuracies due to typing errors or technical reasons.
8.3 Nordical is not responsible for the actions or omissions of Service Providers towards Customers which may lead to damage unless such liability is prescribed by law.
8.4 Nordical is not liable for any unusual or unforeseen circumstances (force majeure) or damage to the Customer resulting from such circumstances.
8.5 Any complaints regarding the Tour must be received by the tour guide without delay. Complaints must also be sent to the Nordical office in writing as soon as possible and at the latest within one month of the end of the Tour in question, otherwise, possible compensation claims will not be considered.
8.6 Nordical reserves the right to limit its liability and the number of damages in accordance with the restrictions provided for in national law or international conventions and these terms.
8.7 Nordical is not liable for damages caused to Customers unless a breach of contract is attributed to Nordical’s negligence. Nordical is not responsible for damage to Customer that will be traced to the act or omission of the Customer himself or a third party. If the Tour does not meet the conditions of the contract, the Customer can demand that it be resolved unless it entails unreasonable costs or significant inconvenience for Nordical.
8.8 Nordical is not responsible for any Customers’ injuries that occurred whilst visiting Iceland. Customers are responsible for their own health and safety whilst visiting Iceland, driving, and participating in Tours and activities in which they are required to pay attention to all safety instructions issued by Service Providers, as well as local laws and regulations.
8.9 Liability Concerning COVID-19: Please note that Nordical is not responsible for additional costs incurred as a result of a positive PCR test and COVID-19 infection occurring whilst in Iceland from arrival point to departure, even for a certified vaccinated individual or those with certified antibodies. These costs not covered include additional hotel reservations, transfers, and domestic and international flights as well as medical expenses. In the event of a positive PCR infection whilst in Iceland, Nordical can assist in rescheduling accommodation and refunding any bookings where possible, but this is subject to terms and conditions of the Service Providers used by Nordical, and as such, this means that Nordical may not be able to issue a refund or reschedule without additional costs.
9.1 All refunds to Customers on the Fare in whole or in part in accordance with these terms are made by a refund to the credit card with which the Tour was paid for. If the cardholder is other than a Customer, the cardholder is responsible for reimbursing the Customer.
10.1 When making a booking, Customers agree that their personal information will be used for the purpose of providing the services requested by Customers and that the personal information will be shared with Service Providers. Nordical reserves the right to use personal information to send Customers targeted e-mails by e-mail and/or text messages, in order to provide Customers with the best possible service. The processing of personal information is discussed in more detail in Nordical’s Privacy Policy.
11.1 In addition to these Terms and Conditions of Nordical, the following special terms apply to Group Bookings.
11.2 The Group Contact is responsible for informing other Customers in the booking about the Tour, the contract between the parties, and these terms. The Group Contact for the booking shall be authorized on behalf of the group to handle communication regarding the Tour with Nordical and negotiate with Nordical on the terms of the Tour, payments, and other matters on behalf of all Customers in the group.
11.3 The Group Contact for the group guarantees that Customer information is sent to Nordical no later than 6 weeks before the start of the Tour and it also includes room lists for hotels if the hotel is part of a Tour. After the information has been submitted, a change fee will be paid for all changes to the booking.
11.4 When transferring a booking in the case of a Group Booking, it is a condition that the Group Contact approves the transfer.
12.1 These Terms and Conditions and any agreement to which they apply are governed in all respects by Icelandic law. Disputes arising from these terms shall be brought before the District Court of Reykjavík.
